These Terms and Conditions (“Terms”) govern your access to and use of the website https://netserveit.in (the “Website”), and any enquiry, quotation, purchase order, rental, AMC, repair, or related commercial engagement with Netserve IT Solutions Private Limited (“Netserve IT Solutions”, “we”, “us”, or “our”).
By using the Website, submitting an enquiry, requesting a quotation, placing an order, accepting a delivery challan, or otherwise dealing with us, you agree to these Terms. If you do not agree, please do not use the Website or proceed with a commercial engagement.

2. Who these Terms apply to
Our Website and commercial offerings are primarily intended for business customers (B2B), including enterprises, system integrators, resellers, MSPs, and project buyers. By engaging with us, you represent that you have authority to bind the organisation you represent.
We may refuse or cancel an enquiry or order where we reasonably believe the request is fraudulent, incomplete, not for a legitimate business purpose, or outside our supply capability.
3. Scope of our offerings
Depending on availability and the written commercial terms we issue, our offerings may include:
- supply of new networking and IT hardware;
- supply of refurbished / pre-owned hardware (clearly identified as such);
- short-term or project-based hardware rental;
- AMC, repair, replacement support, and related lifecycle services;
- technical consultation and sourcing assistance; and
- quotations, commercial proposals, and delivery documentation.
Product listings, catalogues, and Website descriptions are for information only. Exact model, condition, quantity, commercials, warranty, and delivery commitments are confirmed only in a written quotation, purchase order acceptance, rental agreement, AMC document, or other signed/accepted commercial instrument issued by us.
4. Website use and enquiries
You may use the Website to learn about our products and services and to submit enquiries through forms, WhatsApp chat, phone, or email. You agree to provide accurate and complete information and not to misuse the Website (including spam, scraping, attempt to disrupt systems, or submission of unlawful content).
Submitting an enquiry does not create a binding sale, rental, or service contract. A binding engagement arises only when we issue and you accept a quotation / proposal in writing, or when we accept your purchase order / commercial confirmation in writing (including email), subject to stock and other stated conditions.
5. Quotations and commercial documents
Quotations are typically valid for the period stated on the quote (or, if none is stated, for a limited period at our discretion). Prices, taxes, delivery timelines, and stock availability may change until an order is confirmed.
Any terms printed on a quotation, comparison proposal, or delivery challan apply to that specific engagement and prevail over Website marketing copy to the extent of conflict. Website Terms continue to apply to Website use and to matters not covered in the specific commercial document.
6. Pricing, taxes, and payment
- Prices are generally quoted in Indian Rupees (INR) unless otherwise stated.
- Applicable GST and other statutory levies will be charged as per Indian law and as shown on the quotation / tax invoice.
- Payment terms (advance, against delivery, credit, etc.) are as stated in the accepted quotation or order confirmation.
- Where bank details are provided on a quotation or invoice, payments must be made only to the account named therein. We are not responsible for losses arising from payment to unofficial accounts.
- Title to goods generally passes only after full payment is received, unless we agree otherwise in writing. Risk may pass earlier as set out in delivery terms.
7. Delivery, inspection, and risk
Delivery timelines are estimates unless expressly guaranteed in writing. Delays may occur due to logistics, customs (where applicable), OEM/channel constraints, force majeure, or incomplete customer information (site address, contact person, GST details, etc.).
- Please inspect goods upon delivery and notify us promptly of transit damage, shortage, or wrong model, ideally within 48 hours of receipt (or such other period stated in the commercial document).
- Risk in the goods typically passes on delivery to the address / carrier nominated by you, unless otherwise agreed.
- For rental and project deployments, additional handover / return conditions may apply and will be stated in the rental paperwork.
8. New vs refurbished products
New products: Sold as new subject to OEM/channel condition and any warranty stated in the commercial confirmation.
Refurbished / pre-owned products: Sold as used/refurbished and may have cosmetic wear consistent with prior use. Functionality, included accessories, warranty (if any), and DOA policy will be as disclosed for that sale. Refurbished goods are not equivalent to new OEM sealed stock unless expressly stated.
9. Rental, AMC, and repair services
Where we provide rental, AMC, repair, or replacement support:
- service scope, response expectations, exclusions, and commercials are governed by the specific service / rental document;
- rented equipment remains our property and must be returned in good working condition (fair wear and tear excepted) as per the return checklist;
- loss, theft, negligence, unauthorised modification, or misuse of rented equipment may attract repair / replacement charges; and
- AMC and repair outcomes depend on part availability, OEM support pathways, and the age/condition of equipment.
10. Warranty and support
Warranty, if any, is as stated on the quotation, invoice, or product confirmation. For OEM-warranted items, warranty claims may need to follow OEM / authorised channel processes. We do not automatically extend OEM warranty beyond what the manufacturer or channel provides.
Except as expressly stated in writing, we do not warrant uninterrupted Website availability or that any particular model will remain continuously in stock.
11. Cancellations, returns, and DOA
Because much of our business is project-specific B2B sourcing:
- cancellations after order confirmation may not be accepted, or may attract restocking / logistics charges;
- returns are accepted only with our prior written approval and in line with the applicable commercial / DOA policy;
- opened, installed, configured, or customer-damaged goods are generally not returnable unless required by applicable law or expressly agreed; and
- where a DOA window is offered (for example on certain refurbished sales), it applies only as stated for that transaction.
12. Intellectual property
Website content, branding, logos, product copy, and design are owned by Netserve IT Solutions Private Limited or its licensors. OEM brand names (Cisco, Fortinet, Juniper, Aruba, MikroTik, Ubiquiti, Dell, HPE, Lenovo, and others) are trademarks of their respective owners and are used for identification of compatible / related products. No licence is granted to use our or any third-party marks without permission.
13. Third-party brands and compatibility
We supply multi-brand hardware. Compatibility, software licensing, feature sets, and support entitlements depend on OEM policy and the specific SKU. Customers are responsible for validating interface, software, licensing, and deployment requirements for their environment before purchase.
14. Limitation of liability
To the maximum extent permitted by applicable law:
- our aggregate liability arising out of any order or engagement is limited to the amounts actually paid to us for that specific order / engagement;
- we are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, business interruption, or data loss; and
- nothing in these Terms excludes liability that cannot be limited under Indian law (including for fraud or wilful misconduct).
15. Indemnity
You agree to indemnify and hold us harmless from claims, losses, and expenses arising from your misuse of the Website, inaccurate information you provide, unlawful use of products/services, or breach of these Terms or of a commercial document between us.
16. Privacy
Personal and business contact data submitted through enquiries, forms, WhatsApp, or email is used as described in our Privacy Policy, which forms part of these Terms by reference.
17. Force majeure
We are not liable for failure or delay caused by events beyond reasonable control, including natural disasters, epidemics, strikes, transport disruption, government action, war, cyber incidents, OEM/channel allocation issues, or utility failures.
18. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective / last-updated date. Continued use of the Website after changes constitutes acceptance of the updated Terms. For active commercial contracts, changes to Website Terms do not retrospectively alter signed quotation / PO terms unless both parties agree in writing.
19. Governing law and disputes
These Terms are governed by the laws of India. Subject to mandatory law, courts at Gurugram, Haryana shall have exclusive jurisdiction over disputes arising from Website use or from engagements with Netserve IT Solutions Private Limited, unless a specific commercial contract states a different dispute mechanism.

These Terms are provided for transparency in our Website and B2B dealings. They are not a substitute for a negotiated contract on large projects. For complex rental, AMC, or high-value supply engagements, additional written terms may apply.
